Guilford of Maine warrants for a period of five (5) years from the date of its invoice that woven fabric will not suffer “wear through” in normal indoor use by the original end-use customer. “Wear through” means a hole caused by disintegration of the fabric’s structure in a particular area as a result of abrasive wear. Should a failure to conform to this warranty appear in the fabric during the 5-year warranty period, Guilford of Maine will replace the affected fabric at its expense, subject to receipt of prompt written notice during the warranty period.

Guilford of Maine warrants that all shipments of fabrics meet or exceed ACT (Association for Contract Textiles) quality and performance standards for woven fabrics and for knit fabrics.

The Guilford of Maine warranty does not cover damage, disintegration or loss arising from abuse, misuse, vandalism, burns, cuts, punctures, improper installation or maintenance, use of improper cleaning agents, application of a treatment or finish after shipment by Guilford of Maine, defects in design or manufacture of furniture, inadequate padding, abrasion from other components or furniture, pilling, fading, use in application other than normal indoor use or use subsequent to ownership by the original end-user.

This warranty is in effect as of January 1, 2018 and products shipped prior to January 1, 2018, will retain the warranty coverage in effect at the time they shipped.

TO THE FULL EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT, INCLUDING THE PRODUCTS SOLD ON THE WEBSITE, ARE PROVIDED TO THE USER ON AN “AS IS” BASIS, EXCEPT FOR THE ABOVE-NOTED WARRANTY, AND GUILFORD OF MAINE DISCLAIMS ALL OTHER WARRANTIES PERTAINING TO THE WEBSITE OR THE PRODUCTS, INCLUDING ALL WARRANTIES OR IMPLIED CONDITION OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ANY IMPLIED REPRESENTATION OR WARRANTY ARISING OUT OF OR PROVIDED IN THE NORMAL COURSE OF BUSINESS OR AS A TRADE CUSTOM, AND ANY WARRANTY THAT THE WEBSITE WILL AT ALL TIMES BE OPERATED WITHOUT INTERRUPTION, ERROR FREE OR FREE FROM RISKS OF VIRUSES OR PROGRAMS THAT MAY DAMAGE COMPUTERS.

WHILE GUILFORD OF MAINE PROVIDES CERTAIN ENCRYPTION TECHNOLOGIES AND USE OTHER REASONABLE PRECAUTIONS TO PROTECT PERSONAL INFORMATION, GUILFORD OF MAINE DOES NOT AND CANNOT GUARANTEE OR WARRANT THAT THE INFORMATION TRANSMITTED THROUGH THE WEBSITE IS SECURE AT ALL TIMES, OR THAT SUCH TRANSMISSIONS ARE FREE FROM DELAY, INTERRUPTION, INTERCEPTION OR ERROR.

GUILFORD OF MAINE DISCLAIMS ALL LIABILITY FOR ANY DAMAGES, INCLUDING ANY INDIRECT, PUNITIVE, CONSEQUENTIAL OR SPECIAL DAMAGES REGARDING THE WEBSITE OR THE PRODUCTS, EVEN IF SUCH DAMAGES ARE FORESEEN OR FORESEEABLE.

EXCEPT FOR THE ABOVE-NOTED WARRANTY, GUILFORD OF MAINE EXPRESSLY DISCLAIMS ANY LIABILITY FOR CLAIMS RELATED TO NORMAL WEAR AND TEAR OF ANY SOLD PRODUCT, TO THE MISUSE OR ABUSE OF THE PRODUCT, TO ANY CHANGE TO THE PRODUCT OR TO THE WRONG CHOICE OR SELECTION OF PRODUCT.

FOR EACH ORDER, GUILFORD OF MAINE’S LIABILITY IS LIMITED TO THE PURCHASE PRICE PAID BY THE USER IN RELATION TO THE RELEVANT SPECIFIC ORDER.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY THE USER FROM GUILFORD OF MAINE, FROM ANYONE REPRESENTING GUILFORD OF MAINE OR THROUGH THE WEBSITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.

THE REMEDIES SET FORTH HEREIN ARE EXCLUSIVE.
